TERMS AND CONDITIONS OF ENTRY

GENERAL

  1. The Promoter is Jones Lang Lasalle (WA) Pty Limited (JLL) (ABN: 23 008 767 762) (Promoter). The Promoter’s address is Level 4, 683-703 Hay Street Mall, Perth WA 6000.
  2. Information on how to enter and the prizes form part of the Terms and Conditions. Entry into this competition (Competition) is deemed acceptance of these Terms and Conditions.
  3. To the extent of any inconsistency between these Terms and Conditions and any other reference to this Competition, these Terms and Conditions prevail.

WHO CAN ENTER?

Subject to the clauses below, entry is open to all residents of Western Australia who have fulfilled the requirements set out below (‘Eligible Entrants’):

  1. Employees, and their immediate families, of the Promoter, related entities, associated agencies and companies, contractors or individuals are not eligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin.
  2. Any entrant who is under the age of 18, as of the date of entry, is not eligible to enter this competition.
  3. Any entrant who does not reside in WA with a valid residential address, is not eligible to enter this competition.

WHEN TO ENTER

  1. The competition commences on 31st August 2020 at 12am and closes on 4th and 9th September 2020 at 5pm (Promotional Period).
  2. Entries must be received by the Promoter prior to the end of the Promotional Period.
  3. The time of entry will in each case be the time the online entry is received by the Promoter, not at the time of transmission by the Eligible Entrant.
  4. The Promoter accepts no responsibility for any late entries or delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.

HOW TO ENTER

  1. To enter Eligible Entrants must, during the Promotional Period visit https://enexperth.com.au/welcome-back-1/ OR https://enexperth.com.au/welcome-back-2/ follow the prompts to the promotion entry page, input all requested details (being name, email address and mobile phone number) and submit the fully completed online entry form.
  2. Completing all requested details in the online entry form, is an Eligible Entry.
  3. Only an Eligible Entry made by an Eligible Entrant will be placed in the draw for the prize.
  4. Incomprehensible, illegible, and incomplete entries will be deemed invalid.
  5. Any entry that is made on behalf of an Eligible Entrant by a third party will be invalid, unless the Eligible Entrant requires the assistance of a third party to enter due to a disability.

DISQUALIFICATION

  1. Any entrant found to:
    1. have used a third party (including online competition entry site) to enter on their behalf (other than as permitted under clause 15);
    2. have entered incorrect contact details;
    3. have provided false information or who seeks to gain an unfair advantage or to manipulate this Competition; or
    4. not be an Eligible Entrant,

(Disqualified Entrant) will have their entry invalidated and any claim they have to any prize will be invalidated.

  1. If a Disqualified Entrant is awarded a prize and then found to be a Disqualified Entrant, the Disqualified Entrant must immediately return the prize awarded.
  2. The Promoter has sole discretion to determine if any entrant is a Disqualified Entrant.
  3. The Promoter reserves the right, at any time, to request whatever documentation it deems necessary to confirm if the entrant is a Disqualified Entrant. An entrant must provide any requested documentation to the Promoter promptly upon request.
  4. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

NUMBER OF ENTRIES PERMITTED

  1. Multiple entries are not allowed.

DRAW AND NOTIFICATION OF PRIZE WINNERS

  1. One thousand winners will be drawn at random on 7th September Another one thousand winners will be drawn at random on the 9th September 2020.
  2. The winners will be notified by email on 7th September 2020 and 9th September that they have won a prize.
  3. The winners will then receive a text message from The Card Network within 48 hours of the email notification from the Promotor. The text message will contain instructions on how to download the prize (a digital gift card) and how to activate their gift card.

PRIZES

  1. Each winner will receive a twenty dollar ($20.00) pre-paid Mastercard (Mastercard Prepaid Digital Card). The Mastercard Prepaid Card is managed by third party provider, being The Card Network.
  2. The Mastercard Prepaid Card can be redeemed at enex food retailers, including restaurants and takeaway venues within the centre.
  3. Each winner must use their Mastercard Prepaid Card by 1st October
  4. Any ancillary costs associated with redeeming the Mastercard Prepaid Card are not included. Any unused balance of the Mastercard Prepaid Card will not be awarded or redeemable as cash.  The winner forfeits any part of a prize that is not taken for any reason.  No compensation will be payable by the Promoter or the Promoter’s related entities if a winner is unable to use any element of the prize for whatever reason.

  6. The Mastercard Prepaid Card is non-transferable.

If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or part of the prize) with a prize of equal value and/or specification, subject to WA legislation and any written directions from a regulatory authority. Cash will not be awarded as a substitute.
  9. As a condition of accepting a prize, the Promoter reserves the right to request winners:
    1. provide proof of identity, proof of age and proof of residency; and
    2. sign any legal documentation as and in the form required by the Promoter and/or prize supplier in their absolute discretion, including but not limited to a legal release and indemnity form.

In the event that a winner cannot provide suitable proof, that winner will forfeit the prize in whole and no substitute will be offered. The Promoter’s decision in relation to any aspect of the Competition is subject to WA legislation but also final and binding on each person who enters. No correspondence will be entered into.

  1. The total value of 2000 gift cards is $40,000.

PRIVACY COLLECTION STATEMENT

The Promoter collects entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). FURTHER TERMS AND CONDITIONS

  1. All times noted in these Terms and Conditions are AWST (Australian Western Standard Time).
  2. All dollar amounts are in Australian dollars.

If, for any reason whatsoever, the Competition is not capable of being run as planned, including (but not limited to) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to State and Territory regulations, including cancelling, terminating, modifying or suspending the Competition, or disqualifying an Eligible Entrant. Eligible Entrants will not seek any compensation whatsoever from the Promoter.
